Retaining Wall Permit Requirements in Wasatch and Summit County

A retaining wall looks simple from the driveway. Stacked block, a little backfill, done. What is actually happening is a structure holding back tons of soil, water, and slope pressure for decades. That is why a retaining wall permit exists, and why the jurisdictions across the Wasatch Back pay close attention to how these walls get built.

When a permit is required

Most Utah jurisdictions build their rules on the International Residential Code and the International Building Code. Under those codes, a retaining wall generally does not require a building permit when it is four feet or less measured from the bottom of the footing to the top of the wall, and when it is not supporting a surcharge or impounding flammable liquids.

That last part matters more than the height. A surcharge is any added load behind the wall. A driveway, a parking pad, a pool, a slope that keeps climbing, or adjacent structures sitting near the top all count. A three foot wall with a driveway behind it can absolutely trigger a permit requirement, while a four foot wall on open ground may not.

Permit requirements are also amended locally, and some cities set a lower threshold or require zoning approval separately from the building permit application. Always confirm with city planning or the county building department before you order material. The permit required threshold in one town is not automatically the threshold in the next one over.

What tiered walls change

Stacking two shorter walls up a slope does not reliably avoid a retaining wall permit. Building officials look at whether the upper wall surcharges the lower one, and when the horizontal separation is too small, tiered walls get evaluated as a single taller wall. A common rule of thumb is that the walls need to be separated horizontally by at least twice the height of the lower wall to be treated independently, though the reviewing engineer makes that call.

This is one of the most frequent reasons a wall project stalls midstream. The design was drawn as two independent four foot walls, the inspector reads it as one eight foot structure, and now the wall design needs a licensed engineer before anything else happens.

What a permit application actually requires

Permit requirements for retaining walls vary, but a retaining wall permit application in this region typically asks for construction documents that show what you are building and why it will hold. Expect to provide most of the following.

  • A site plan showing the wall location, the property line, and distance to any adjacent structures

  • Wall height, length, and cross section

  • The material, whether that is segmental block, poured concrete, boulder, or a concrete masonry system

  • Drainage details including backfill material, drain rock, and where the pipe outlets

  • Soils information for taller or surcharged walls

  • Stamped calculations from a structural engineer when the wall exceeds the exempt height or carries a surcharge

Permit fees vary by jurisdiction and are usually tied to valuation, so a larger wall costs more to permit. Building a wall first and pulling permits after the fact almost always costs more than doing it in order.

Property lines, setbacks, and neighbors

Zoning rules are a separate track from the building code, and they are where retaining wall permits often collide with reality on a subdivided lot. Setbacks, easements, and height limits near a boundary can restrict where a wall goes even when the structure itself is sound. If a wall doubles as a fence base or sits near a public right of way, expect additional review.

Walls built on private property still affect neighboring properties. Redirecting water uphill or downhill of a shared boundary creates liability that outlasts the construction schedule. On a residential property with tight side yards, it is worth a conversation with the neighbor before the excavator shows up.

Drainage is the part that fails

Almost every wall failure traces back to water. Soil behind a wall is heavy. Saturated soil is far heavier, and it also generates hydrostatic pressure the wall was never designed to resist. In a valley that collects snowmelt every spring, drainage failure is the single most common reason a wall bulges, cracks, or leans.

Proper drainage means clean drain rock behind the wall, a perforated pipe at the base, filter fabric to keep fines out of the rock, and a daylighted outlet that carries water somewhere useful. It also means grading the ground above the wall so runoff does not sheet straight into the backfill. None of that is visible once the job is finished, which is exactly why it gets skipped by crews competing on price.

Good engineering accounts for water first and geometry second. A wall with sound drainage and modest reinforcement outlives a heavily reinforced wall sitting in saturated clay.

Inspection and closeout

Once the permit is issued, expect at least one building inspection during wall construction, often at the footing or base stage before backfill hides the drainage. Some jurisdictions add a reinforcement or geogrid inspection on segmental systems. A final inspection closes the permit out.

Skipping inspections leaves an open permit on the property, and that surfaces later during a sale, an appraisal, or the next construction project on the lot. It is a small administrative issue that becomes an expensive one at the worst possible moment.

Working with the right people

A licensed contractor who builds walls in this climate knows which soils hold, how frost and snowmelt behave on a north facing slope, and what the local reviewers expect in a permit application. Pairing that experience with a licensed engineer on anything tall or surcharged is what protects the structural integrity of the finished wall.

The engineering, the drainage design, and the permit application are not obstacles to the project. They are the reason the wall is still straight in twenty years.
